Default E39 new egs

I've been having trouble with a TRANS. FAILSAFE. PROG message when the car (e39 540i msport) starts in the morning. Diagnosed it with INPA- it's an EGS error 2 (pressure controller).
Had this changed (i thought this might end up being a bad idea and I was right ) - it hasn't fixed the error, so i've had a very expensive change of trans fluid and filter. I suspect the cause is the actual egs module and to that end i have found another with exactly the same number etc but which is from an e53 (x5). my question i need to reprogram the unit before swapping them over? Should i dump the memory of the original one and upload it into the new unit, and if so, which is the best software to use?

Hi I am green to this but my BMW E46 320D m47 just don't want to start at all after installing a low mileage engine.
